What these terms cover
These terms apply to On The Map Web ("we," "us"), operated by Shane Intindola, and to you as a visitor to this site or a customer of ours. They're written in plain English on purpose — there's nothing buried here.
If you've signed a Service Agreement with us, that signed agreement controls wherever it differs from these terms. These terms fill in the gaps and apply to everyone; the Service Agreement is the specific deal between us and one client.
The service
We design and build a custom website for your business. You buy the build itself; hosting and ongoing edits are a separate and entirely optional service.
- The build — a one-time price, based on the scope of the site. We build your first page free and without obligation; beyond that first page, the price is quoted and agreed in writing before any further work starts. Once it's paid, you own the finished website files outright. Every build includes a stated number of revision rounds.
- Aftercare, from $99/month — entirely optional. Monitoring, backups, security checks, a monthly report, and a stated number of rounds of changes. Hosting is included free with every build and stays free whether or not you take a plan, and the first three months of aftercare come with your build at no charge. No setup fee, month-to-month, cancel anytime.
All prices are plus applicable Texas state and local sales and use tax.
Edits
"Reasonable edits" means normal updates: text, photos, hours, services, contact info. The response time that applies to you is the one set out in your plan. Larger work (a full redesign, new pages, e-commerce, new integrations, custom features) is quoted separately and needs your written go-ahead before we start.
Changes are counted in rounds, and a round means the same thing everywhere: one consolidated set of changes, sent once, and worked through together. You never need a plan to have work done — any change can simply be quoted on its own.
During the build, each tier includes a stated number of rounds, agreed in writing before work starts. Additional rounds are available at a stated per-round rate, quoted before they're started. A change of overall direction (a different look, structure, or scope from what was agreed) is a new quote rather than a revision, and we'll always tell you which one something is before doing the work. On an aftercare plan, your plan states how many rounds are included; anything beyond that is quoted before it starts, so you always know what a round costs before you spend it.
Hosting & uptime
We host your site on reliable infrastructure and aim for continuous uptime, but we don't guarantee it will never go down — no host can honestly promise that. We're not responsible for outages caused by third-party hosting providers, domain registrars, or platforms outside our control. We fix what's in our power to fix, promptly.
We also don't guarantee specific search rankings, traffic, leads, or revenue. Anyone who does is guessing.
Your content and accuracy
You're responsible for the accuracy of what you give us — business name, logo, photos, license numbers, certifications, and claims about years in business, insurance, or warranties. By providing them, you confirm they're true and that you have the right to use them.
We build demos using clearly-labeled representative imagery and replace it with your real photos once you send them. We never present demo imagery as your actual work, staff, or results. We won't publish a claim, license number, or owner name you haven't confirmed.
We don't provide legal advice. You're responsible for the legal sufficiency of your own content, policies, and business practices — including privacy, accessibility, and marketing-consent compliance — unless we've agreed otherwise in a separate written scope.
Payment
Aftercare plans bill in advance and renew automatically to the card on file. By providing a card, you authorize us to charge the agreed monthly amount plus applicable tax each month until you cancel. We'll give you at least 30 days' written notice of any price increase, and the increase won't take effect until you accept it or provide any authorization your card issuer requires.
The build is a one-time payment, due in full before the site goes live under your domain. On larger builds we may agree a deposit in writing before work starts, with the balance due on the same terms. A late or failed aftercare payment may pause the plan services — the monthly reports and your included rounds of changes — after 5 days' written notice; once resolved, we bring them right back. It does not affect your hosting, which stays free.
Cancellation
Aftercare is month-to-month with no contract. Cancel anytime in writing (email or text) with 7 days' notice, effective at the end of the current paid period. Fees already paid for that period aren't refundable.
We may also cancel without cause on 7 days' written notice — and if our cancellation takes effect before the end of a period you've paid for, we refund the unused prorated portion. We may suspend or terminate immediately for unlawful content or misuse, with notice where practical.
On cancellation of aftercare, we make your own supplied content (logo, photos, text) available for export for 30 days, after which it may be deleted from our systems. You keep the website files you paid for: cancelling aftercare ends the reports and the included rounds of changes. It does not end your hosting, which stays free, and it does not affect your ownership of the build. Your domain name is always yours.
Ownership
- Your domain name: always yours. If we register it for you, it transfers to you on request.
- Your supplied content: always yours. You grant us a license to use, edit, and display it solely to build and run your site.
- The build: on payment in full, we assign you the copyright in the custom design and code built specifically for your site. This applies on every tier, whether or not you ever take an aftercare plan, and it does not lapse if you cancel one. It does not include our own reusable tools, templates, or techniques, or third-party software, fonts, stock imagery, or platforms used under license — those stay licensed, not owned, and you may need your own license to keep using them.
We may show your finished site in our own portfolio and marketing unless you ask us not to in writing.
If we can't continue
We're a small operation, and it would be dishonest to pretend otherwise. If we become unable to continue providing services for any reason, we (or our representative) will deliver your site files and DNS control to you, and refund the unused prorated portion of any period you've already paid — on the same terms as a cancellation by us.
Disclaimers, liability, and governing law
The site is provided "as is." We perform our services with reasonable care and skill.
EXCEPT AS EXPRESSLY STATED IN THESE TERMS, ON THE MAP WEB DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
Our total liability under these terms will not exceed the greater of (a) the fees you paid for the service giving rise to the claim, or (b) the fees you paid in the 3 months before the event giving rise to the claim. Neither party is liable for indirect, incidental, or consequential damages.
Neither party is liable for delay or failure to perform caused by events beyond its reasonable control, except that payment obligations for services already delivered aren't excused.
Neither party may transfer these terms to someone else without the other's written consent — except that we may assign them to a successor entity that continues the same business (for example, a company we form), provided your pricing and terms stay the same.
These terms are governed by the laws of the State of Texas. Exclusive jurisdiction and venue for any dispute lies in the state courts located in Harris County, Texas.
Privacy
We collect only what we need to build and run your site and to contact you, and we don't sell your information. The full details — including text-messaging consent, your rights, and how long we keep things — are in our Privacy Policy.
Changes to these terms
We may update these terms occasionally. The "Last updated" date above reflects the most recent change. If a change materially affects an active client, we'll tell you directly rather than quietly editing this page.
